Terms and Conditions

File types are decided by the designer for the use specified by the client at the point of inquiry.
The standard file provided via email for design use is a .PNG
Master files are NOT INCLUDED with a design service. 

All design work must be paid in full to A Marshall Concepts LLC before any artwork is made for the purchaser. A Marshall Concepts LLC retains the right to use the design in a portfolio and for any advertising or marketing as seen fit by the designer. Please allow up to 14 business days for design completion. Please DO NOT HASSLE OUR DESIGNERS! Creative quality isn't rushed!

Full Payment is due upfront. We do not provide samples of work before payment is made. Payments are accepted via PayPal only. All invoices come standard with PayPal's buyer protection. 

Turnaround times:

All customized items have a 3-5 business day digital creation time to give our designers enough time to deliver in the first phase of the design process. The completion time for any digital design is still contingent upon feedback. It is important that the client responds back to us within 24-72 hours of receiving proofs via email to ensure a timely completion within the 5-7 full digital creation turnaround time.

Rush services are available for an additional cost and are not exempt from the feedback requirement. Feedback is critical and can delay the estimated completion time.

Ownership of Designs 

We release all rights of use and ownership to the purchasing party for the exception of our right to use any design work we create in our portfolio and advertisements. We will not claim ownership of any royalties made by the owner using the purchased design. 

Feedback is critical in this process! It is important to respond to our emails in a timely manner to prevent additional days added to the completion of your design. Please reply with your feedback/response to emails within 1-2 business days. Please note, if we do not receive a response within the time frame specified, an additional 5 business days will be added to the completion of your design.

***Rush services are non-refundable. If rush services are applied, you must respond within 1 business day. If we do not receive a response within the time frame specified, you will lose your agreed completion date and your design will default to our standard 7-14 business days. *** 

Custom physical products MUST BE APPROVED VIA PROOF EMAIL PRIOR TO being shipped.


PROCESS:

WE DESIGN IN PHASES AND WORK WITH COMPLETE TRANSPARENCY! 

PHASE#1- WE SKETCH UP THE CONCEPT TO ENSURE WE HAVE A ROUGH IDEA OF YOUR DESIGN FOR YOUR APPROVAL.
PHASE#2- WE WORK THE CONCEPT INTO A SEAMLESS DESIGN. AGAIN WE SEND A SAMPLE FOR YOUR APPROVAL. ****(THERE ARE NO REFUNDS AFTER THIS PHASE!)****
PHASE#3-WE ADD COLOR, ADJUST FONT, EFFECTS AND SEND A SAMPLE FOR YOUR APPROVAL.
PHASE#4-WE FINALIZE THE DESIGN FILE INTO THE APPROPRIATE FILE TYPE FOR THE USE OF DESIGN THEN EMAIL THE FILE(S) FOR YOUR REVIEW. IF YOU ARE SATISFIED, THE FILE(S) ARE READY FOR USE. IF THERE ARE MINOR ADJUSTMENTS (COLOR, SPELLING, WORD PLACEMENT, ETC) LET US KNOW IMMEDIATELY IN RESPONSE TO THE EMAIL (WE ARE NOT RESPONSIBLE FOR THESE ELEMENTS AND IT IS ON THE PURCHASING PARTY TO CONFIRM ACCURACY.) REVISIONS OF ANY PRIOR APPROVED PHASE WILL INCUR A REVISION FEE THAT MUST BE MADE PRIOR TO THE CHANGE. 

NO DEPOSITS!

Our designs are custom made to order and do not come with unlimited design revisions. If you would like to revise a previously approved phase, there will be a $50 revision fee that must be paid prior to application. If there is an urgency for a design to be completed and it wasn't previously stated, the appropriate rush fee will be applied and must be paid prior to rush services being applied. 

REFUNDS

We strive to provide our clients with the best possible printing experience.  Clients receive digital proofs of all custom products via email prior to their order being printed. Orders will not be sent to print until the client approves a digital proof. 

There are no refunds on custom printed products 

Due to the nature of digital design work, there are no refunds if any part of any digital design is seen by a consumer. If you decide to cancel after work has started during the sketch phase (before any part of the sketch is shown), a 100% refund is issued. After the sketch has been shown and approved, there are no refunds. Unless otherwise agreed upon, there are no additional discounts on designs. Upon making payment for services, you hereby agree to have read and accepted all terms and conditions set forth by A Marshall Concepts LLC.  

DEFECTIVE PRINTING

If you are not 100% satisfied with your order for any reason, please contact our customer service department at contact@amcpts.com with your order number which can be found in your emailed receipt.

In most cases, clients will be requested to submit digital photos documenting the product defect and/or ship the defective products back to us. All policies are subject to change without prior notification. Defective product reprints shall not exceed the amount paid by the customer or $1,000.00 (whichever is less). Determination of defect is at the sole discretion of A MARSHALL CONCEPTS, LLC.

Due to color differences on-screen and on physical products, A MARSHALL CONCEPTS LLC will not issue reprints because of color discrepancies.

Turnaround and shipping for reprint orders will vary depending upon available production capacity and manager's discretion.


Limitation of Liability

IN NO EVENT SHALL A MARSHALL CONCEPTS LLC, ITS AFFILIATES OR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR CONTENT OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR DIRECTLY OR INDIRECTLY RELATED TO THE GRAPHIC SERVICES RENDERED, OR THE INABILITY TO USE, THE SITE OR THE CONTENT, MATERIALS AND FUNCTION RELATED THERETO, INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, OR ANTICIPATED PROFITS, OR LOST BUSINESS, DATA OR SALES, OR COST OF SUBSTITUTE SERVICES, EVEN IF A MARSHALL CONCEPTS LLC OR ITS REPRESENTATIVE OR SUCH INDIVIDUAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF A MARSHALL CONCEPTS LLC TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR OTHERWISE) ARISING FROM THE TERMS OF YOUR USE OF THESE SITES EXCEED, IN THE AGGREGATE, THE TOTAL COST OF SERVICES.
